On 13 December 2024 a Decree Law, number 6/2024, has changed the sales in the Balearic Islands.
In reaction to the terrible consequences of the DANA in Valencia, the reaction of the Consell de Baleares has been quick, maybe too quick.
– First of all, a restriction on the application of the Decree Law 3/2024 concerning the legalisation of illegal houses is established. The houses that are located in flood risk prevention zones until the preferential flow or flood zones are defined, which will be the criteria for prohibiting construction or legalisation.
– It will not be possible, and this as a preventive measure, to grant any licence for the construction of dwellings in RPA flood protection zones until a precise map of the preferential flow or flood zones is established, which once established will be the criterion for granting or not granting a licence.
– It is necessary to declare in the sale of properties if the property is in a risk zone, this is required by the Notary because he is obliged to do so, if the buyer does not inform, notaries and lawyers could be fined between 30.000 and 90.000 because it is considered a serious infringement. In the signings at the beginning of the year, one notary required certification by the owner that the house was not in a flood zone, and another worked with the IDEIB maps.
